It is a contract of life annuity which allows an occupation of the property during the whole life of the sellers.
A sum lump is paid by the buyer, without any annuities.
It is in fact a life annuity occupied without pension.
The difference with the previous contract lies in the fact that the “crédirentier” can rent the properties in case of his early departure from the good.
Fiscally, it does not enter into the “holdings” of the buyer and thus it is not subjected to the ISF.
The bare ownership can be temporary or for life.
Because there is not a pension, the sale with right of use like the bare ownership can be financed by a bank loan on the contrary of the life annuity or term sale.
Besides, these two types of contracts allows to benefit of an important “discount” on the property as well as on the transfer taxes.
